Proposals for enforcement using Health and Safety at Work Act (HSWA) powers: IET comments to the Office of Rail Regulation (ORR).
Abstract The ORR’s current approach to health and safety law has the benefit of substantial enforcement experience. This review is, however, viewed as necessary and timely in anticipation that outcomes may lead to health and safety enforcement improvements. The enforcement principles are founded upon industry experience and common sense, and are therefore appropriate. The ‘operational railway’, particularly trains, tunnels and infrastructure that fall outside the Regulatory Reform (Fire Safety) Order 2005, would benefit from greater clarity over the application of fire safety legislation through the clarification of responsibilities and communication of the detail of agreements in place with non-rail industry fire authorities.
