Product Safety and Liability: Staying on the right side of the Law

Speaker: Dai Davis, Partner, Brooke North LLP

Product safety affects all products and systems.  Even software must be “safe”. In some circumstances, specific additional rules apply such as the CE Marking legislation for machine safety or electromagnetic compatibility.  However, all products are caught by general legislation from the European Product Liability Directive to the United Kingdom’s new rules on Corporate Manslaughter.

About this event

Product safety affects all products and systems.  Even software must be “safe”. In some circumstances, specific additional rules apply such as the CE Marking legislation for machine safety or electromagnetic compatibility.  However, all products are caught by general legislation from the European Product Liability Directive to the United Kingdom’s new rules on Corporate Manslaughter.

Many believe that product liability is something only manufacturers need concern themselves with.  This is far from the truth.  Not only do retailers and consultants in the distribution chain have product liability obligations under civil law, they can also be prosecuted under criminal product liability legislation.

Dai Davis, who is an acknowledged expert in product safety, product liability and product recall will discuss the liability that manufacturers, consultants and others in the supply chain have.  He will also explain how that liability and the associated risks can best be mitigated.

Having been head of Intellectual Property and then Information Technology law nationally for Eversheds for several years, Dai is now a partner at Leeds based Brooke North LLP, although he also works out of London on a regular basis.
